Work – Freiburg im Breisgau – doctor fired for criticizing corona policy: process – career

Freiburg (dpa / lsw) – The state labor court of Baden-Württemberg has to deal today (9 a.m.) with the dismissal of a police doctor because of public criticism of the Corona policy. According to the court, she had published a classified ad under her name in a free Sunday newspaper, which was headed “Infection Protection Act = Enabling Act”. Among other things, there is also talk of “compulsory vaccination” and there is a reference to a demonstration in front of the Bundestag against the Infection Protection Act.

The state of Baden-Württemberg justified the ordinary dismissal primarily with the plaintiff’s lack of suitability for working as a police doctor (Az: 10 Sa 66/21). In addition, she violated contractual obligations. “One of the duties of loyalty is not to disparage the state, the constitution and state bodies. The plaintiff’s conviction is not covered by the fundamental right to freedom of expression,” the court said in a statement. The plaintiff sees it differently. She is of the opinion that her extra-official commitment to the protection of fundamental rights is not a breach of her duties towards the employer.

Anette Franz from Lahr (Ortenaukreis) informed the German Press Agency that, like the German police, she stands for the free democratic basic order. With her ad, she had “apparently clairvoyant abilities”: Among other things, she referred to the planned compulsory vaccination and the fact that quarantine refusers were forcibly accommodated. Her ad also mentioned “prison.”

The labor court in Freiburg, however, followed the arguments of the state and dismissed the action for protection against unfair dismissal. With the term “Enabling Act”, the woman deliberately referred to the National Socialist Enabling Act of 1933 and thus devalued state organs. The plaintiff has appealed against this, and the hearing is now taking place in Freiburg. A spokesman for the court assumed that a verdict would be issued on Wednesday.

The country also fired the police doctor without notice last summer because, according to the court, she is said to have issued incorrect health certificates. This dismissal will be heard on March 31 before the labor court in Freiburg. According to the spokesman, if the first termination is effective, the second is irrelevant.
