2700 euros fine for attempted fraud – Bad Sckingen

The court remained well below the public prosecutor’s request of 9,000 euros. Judge Lmmlin-Daun was convinced that the gold jewelry worth 33,000 euros, which the accused reported to his insurance company as stolen, never existed. The defendant wanted to enrich himself with the false information.

Since the insurance never paid out the sum, the fraud got stuck in the attempt. The fact that the service was not performed is related to a letter to the insurance company in which a witness expressed doubts about the existence of the jewelry. This witness had a motive to incriminate and was not credible in all points, but in his core statement, the judge said in the grounds for the judgment. Another incriminating evidence is the fact that when the burglary was reported, there was no mention of the loss of valuable jewelry. Not even when the defendant’s daughter informed the police station two days later that there was a lack of 300 euros in cash and gold chains for children. It wasn’t until four months later that the listing and photos of the allegedly stolen jewelry were reported to the insurance company. With this unprofessional approach, the insurance would probably have noticed, even without the incriminating letter, that something could be wrong. Defense attorney Filippo Siciliano said after the verdict that he would take the verdict to the last instance.
