After the Berlin public prosecutor’s office investigated the managing director for fraud and delaying insolvency, the Charlottenburg district court has now opened preliminary insolvency proceedings
It seemed only a matter of time: After the German subsidiary of the online charter platform Zizoo had massively deprived customers of their money for more than six months by not passing them on to the charter fleets, the Charlottenburg district court has now initiated insolvency proceedings against the company initiated. YACHT had reported in detail about the case (YACHT 25/2023), and more than a dozen readers who had been deprived of their deposits had contacted the editorial team. Dozens of similar cases were found on online review portals such as Trustpilot and Tripadvisor, not exclusively from German customers. In the last few months, various affected parties have already hired lawyers and, in some cases, obtained enforcement notices. Managing director Anna Banicevic continued to put off customers until the end and promised refunds at the beginning of this year. Since this did not happen in most cases, some of those affected had now filed criminal charges against the Croatian and the Berlin public prosecutor’s office recently opened an investigation into fraud and delay in insolvency. The outcome can then be important for creditors if the claims from the insolvency estate cannot be satisfied, which is quite often the case with charter agencies in insolvency.
According to its own information, Zizoo is one of the “world’s leading online agencies” on the charter market. According to its own statements, the online start-up run by Croatian Anna Banicevic has now raised around $30 million in various investor rounds over the last few years. As part of the growth, Zizooboats GmbH was founded in Berlin in spring 2017, also with the Croatian as managing director. Only the German subsidiary GmbH in Berlin is now affected by the insolvency; Zizoo’s headquarters are in Austria. The company’s website is still online.
