Zelensky prepares amendments to the Constitution on the issue of decentralization

In particular: whether the territorial communities will have the status of a legal entity. In the conditions of Ukraine, a legal entity is guided not only by the Constitution, but also by other legislation, in particular civil, said Stefanchuk.

“As an expert on civil law, I can say that legal entities have such rights as unification, separation, merger. Will this not lead to separatism at the state level, if we give this status? It’s like an elementary example,” he explained.

In addition, there are different positions on the issues: whether or not to leave the district councils, whether the head is a body, or an official, because “here a number of problems arise regarding the empowerment of him.”

“It is also important to resolve issues regarding the dissolution procedure and a number of others. And therefore we need to resolve these issues, on which we have already expressed all the arguments. It is just necessary to make a political decision,” he said.

Stefanchuk hopes that approximately by the end of September, the bill will be submitted to the Verkhovna Rada.

“Now the question of completing the legal refinement of the text is being asked. And I very much hope that by the Day of Local Self-Government (December 7 – ed.), We will try to resolve this issue at some stage,” he said.

According to Stefanchuk, two sessions are needed to amend the Constitution.

“This means that if at this session we adopt it in the first reading, then in February we will be able to vote for it in the second,” he said.
