The autonomous communities shield themselves against a possible new wave of coronavirus. Less than a week after the start of the Christmas campaign with ‘Black Friday’, some autonomies have already established the COVID passport to enter closed public spaces, while others wait for justice to give them the green light to do so.
The epidemiological situation in Spain is still not as worrying as in other European countries, such as Hungary who has returned to home confinement. Although, everything indicates that our country will face the sixth wave of the pandemic in just a few weeks. In fact, the upward trend in infections has been confirmed this weekend, when it has again touched 7,000 positives.
Faced with this situation, the regional governments have opted for the COVID certificate to promote the vaccination of citizens who have not yet been inoculated with COVID serum. In our country, 90% of those immunized with the complete regimen have already been reached, taking into account the target population (over 12 years of age).
Galicia
The nightlife venues and pilgrim hostels in Galicia already request a vaccination certificate, a negative diagnostic test or a document proving recovery of the disease recently.
In addition, the TSXG has authorized the Xunta to implement the “preventive health security measure” consisting of the display of the COVID passport for access to public and private hospitals of the Galician Community of the visitors and companions, older than 12 years of hospitalized patients. The measure will take effect from 00:00 hours on the day following its publication in the Official Gazette of Galicia (DOG) and until 00:00 hours on December 4.
Baleares
The Superior Court of Justice of the Balearic Islands authorized last week the extension to demand the vaccination certificate in nightclubs. The court considers that the request is justified by “its suitability, necessity and proportionality”.
A) Yes, until next December 8 these types of establishments will continue to request the document from people who want to access their facilities.
Catalonia
The Superior Court of Justice of Catalonia has authorized the request for the COVID certificate in the hotel and catering establishments, as well as in banquet and celebration halls. They may also request it in activities that involve an important interaction of people.
Aragon
The Government of Aragon is also pending that the Superior Court of Justice authorizes you to issue an order to require the certificate of access to shows, nightlife venues and to any activity that brings together more than 500 people indoors and more than 1,000 outdoors. The TSJ will foreseeably pronounce this Monday and, if authorized, the order will come into force within 24 hours.
Navarra
The Government of Navarra will request permission this week so that from on November 27 the certificate is required to enter restaurants with a capacity of more than 50 diners, nightlife venues, party rooms, and large indoor events where food or drink can be consumed. If the courts finally authorize it, the measure would be in effect between Saturday, November 27, and Thursday, January 6, 2022, both inclusive.
The Rioja
The president of the Riojan Government, Concha Andreu, has announced that The regional Executive will consult the Superior Court of Justice of La Rioja the possible implementation of the COVID Passport to access some establishments.
Basque Country
The Contentious-Administrative Chamber of the Superior Court of Justice of the Basque Country (TSJPV) has rejected that the ‘covid passport’ can be required in the Basque Country as a condition for accessing nightlife venues and restaurants with more than 50 diners in the Basque Country, a measure for which the regional government requested judicial authorization last week.
