The organization Viruswaarheid had filed a case against the Dutch state. The court in The Hague initially agreed with Viruswaarheid, but the government immediately appealed and the curfew was maintained. The organization around foreman Willem Engel then appealed against this ruling. The Supreme Court rules that “a situation in which the physical safety of the population is threatened by a spreading virus, such as the corona virus in this case, can be an extraordinary circumstance.”
The curfew was introduced at the end of January last year due to the corona crisis. This applied between 9 p.m. and 4.30 a.m., during those hours it was not allowed to be outside without a valid reason.
