US law firm sues Sony for DualSense controller drift – Gaming – News

Sony has been formally sued over reports of a drift issue with its DualSense controllers for the PS5. The law firm that is filing the lawsuit against Sony reported last week that it is a possible class-actionlawsuit against the manufacturer.

US law firm Chimicles Schwartz Kriner & Donaldson-Smith formally filed the indictment this weekend, also writes GamesIndustry.biz. The law firm states that the DualSense controller is faulty due to the alleged drift issue, which would cause the PS5 controller to register movement without the thumbsticks be touched.

The law firm claims that Sony was “aware of the problem,” without disclosing it. The lawyers call Sony’s conduct, among other things, ‘fraudulent’ and ‘illegal’. The company further states that the repair options for consumers are too limited. Among other things, the law firm is claiming compensation for affected DualSense owners.

The law firm reported last week that it explored the options for a class action lawsuit against Sony. The company published a form, among other things, with which gamers who experience the problem can report themselves. It was still unknown at the time whether the charges would actually be filed.

The lawsuit only affects US consumers legally. The problem should basically be under warranty as the product will not function properly when it is experiencing controller drift. A Sony customer service representative in the US reported last week opposite Kotaku that the drift issues would be covered by the DualSense warranty, although consumers should send the controller to Sony for repair at their own expense.

Chimicles Schwartz Kriner & Donaldson-Smith is no stranger to lawsuits against console manufacturers. Some years ago The same law firm sued Nintendo for drifting issues with the Nintendo Switch Joy-Cons. Nintendo has now have been apologized for the Joy-Con drift problem, which has since become the subject of multiple lawsuits. The European Commission would also consider an investigation into the Joy-Con situation, writes IGN.
