Urgent Court Decision: Development Permit Suspended for Priaires Substitution Reserve in Deux-Sèvres

Monday October 30, the administrative court of Poitiers urgently suspended the development permit for the Priaires substitution reserve, in Deux-Sèvres. Justice rules in favor of the opponents of this project, who believe that there is a conflict of interest.

This is a new victory for anti-basin activists. This Monday, October 30, at the Poitiers administrative court, the summary judge suspended the development permit for the Priaires substitution reserve, in Deux-Sèvres.

“We are delighted, this will make it possible to stop the work”rejoices Joëlle Lallemand, president of APIEEE (Association for the Protection, Information and Studies of Water and its Environment). “If the basin had been built and the court had then ruled in our favour, they would have gone out of their way to use it anyway, like for the Caussade dam.”

The judge considered the conflict of interest among the means invoked by the APIEEE to request a halt to the work. Indeed, the mayor of Val-de-Mignon, who issued the development permit for the reserve last August, is herself a farmer and member of the SCOP de l’eau 79, the group of farmers which supports this project. In its order, the administrative court recalls article L. 422-7 of the town planning code: “If the mayor or the president of the public intermunicipal cooperation establishment is interested in the project which is the subject of the permit application or the prior declaration, either in his personal name or as an agent, the municipal council of the commune or the deliberative body of the public establishment designates another of its members to make the decision.”

The other means raised by the APIEEE to request the interruption of the work were, however, not accepted. The association alerted in particular on “the absence of impact studies attached to the development permit”, “lack of public consultation”or “the absence of a Natura 2000 impact study”.

These points must be studied at a future hearing, a judgment on the merits which should occur within six to twelve months.

At the same time, an appeal on the 16 basins of Deux-Sèvres should be made by the end of the year.
