Urgenda goes back to court in climate case, now to demand periodic penalty payments from the State

Urgenda filed a complaint against the Dutch State in 2013 about its climate policy, in order to force the Netherlands to reduce greenhouse gas emissions more quickly. In 2015 the judge ruled in favor of the climate organization for the first time and in 2018 it happened again on appeal.

Twice it was judged that the State has a duty of care to protect and improve the living environment. The Court of Appeal in The Hague ruled that in 2020 a CO2 reduction of 25 percent compared to 1990 is the minimum for the State to comply with that duty of care. An appeal in cassation against this to the Supreme Court was filed 2019 rejected, making the verdict final.
