Deploying used software licenses is fine. The Office for the Protection of Competition decided on this in a dispute with PREDNY SLM, which sells the used licenses. PREDNY SLM led a dispute with the Export Guarantee and Insurance Company (EGAP), which placed a condition in the tender that the offered software licenses were only new.
The decision of the Office can be studied here. The Office stated that EGAP had set conditions in breach of the Public Procurement Act. At the same time, the Office canceled the tender procedure for the given contract.
The contract specifically covered Windows Server Datacenter, Windows Server Standard, Office Pro Plus, Exchange Server, Exchange Server CAL, Windows Server CAL and RDS CAL.
