Transparency and Access to COVID-19 Vaccines: Challenges in Mexico’s Competitive Market

On May 4, 2023, COVID-19 ceased to be considered an international health emergency. However, after more than 3 years its effects continue to impact the lives and health of thousands of people who do not have access to vaccines, treatments and do not have timely and adequate care in case of acquiring it.

During the pandemic, the power of the States weakened in the face of corporate power through the acceptance of contracts with clauses that favored private benefit, the concealment of information, and the lack of accountability of companies. All of the above is covered by the laws on international trade, investment, patents and intellectual property in which medicines are treated as just another commodity, without considering that health is a fundamental human right whose access must be universal.

In this investigation, we updated the information that we offered last year with the purpose of having a broad perspective on the lack of transparency in the process of authorization, purchase, and access to authorized vaccines in Mexico from the beginning of the pandemic until the announcement of the end of international health emergency.

Mexico has signed 9 contracts with companies for the acquisition of vaccines and the public versions of these contracts were only published in June 2023, after more than two years of requesting that information from the government that continues to hide the money that the Mexican government paid to each of the companies from which it purchased vaccines.

We are facing a new period with new challenges as we move from a controlled market to a competitive market in which pharmaceutical companies begin to market the vaccine with private players and not only with governments, as has been the case up to now.
