JEMBER, KOMPAS.com – A total of seven factions in the Jember DPRD agreed to impeach Jember Regent Faida through the plenary session of the Right to Express Opinion (HMP), Wednesday (22/7/2020).
There are a number of reasons for the DPRD to impeach the first female regent in Jember.
Spokesperson for the Nasdem Hamim Party faction considered that the Jember Regent had broken the oath of appointment and committed a serious violation of the applicable laws and regulations.
“The regent’s policy to change the KSOTK Perbup (Position, Organizational Structure of Work Procedures) without regard to the existing provisions has caused Jember to not get the CPNS and P3K quota in 2019,” Hamim said when delivering the Nasdem faction’s views in a plenary session.

As a result of that policy, Jember Regency is threatened not to get another quota of civil servants in 2020.
Thousands of Jember people and honorary staff or non civil servants of Jember Regency feel disadvantaged.
The second reason, the Jember Regent’s policy of mutation by violating the merit system and staffing rules made the State Civil Apparatus Commission (KASN) drop recommendations that must be implemented by the Regent. 14 days at the latest.
“However, until now the Regent of Jember has not complied with these recommendations and has repeated the same mistakes by making mutually consecutive ASNs,” he explained.

The third reason, the mutation during the 2015 period has carried out the ASN mutation by issuing 15 Regents’ Decrees.
The Minister of Home Affairs assessed that all of these mutations violated the merit system and legislation.
Finally, the Minister of Home Affairs and the Governor asked the Regent to revoke the 15 decree SK.
The regent is asked to return his position as per January 2018.
However, this matter was still left despite mediation more than five times.
The fourth reason, the Bupati’s policy of changing 30 Perbup KSOTK also caused Jember’s governance chaos. The impact is disrupting the joint service to the community.
“Miss regent of Jember It has hurt 2.6 million people of Jember with the determination of opinion on the results of BPK’s examination with the title of disclaimer, “he stressed. Namely the performance evaluation of the regent and his staff are not in accordance with the applicable laws and regulations in carrying out local financial governance.
For this reason, the NasDem Party Faction approved the Plenary Session of the HMP proposal to dismiss Faida from the post of regent of Jember.
Furthermore, it must be followed up using the applicable legal mechanism.
Meanwhile, Chairman of the PDI-P faction Edi Cahyo Purnomo added the reason for the impeachment of the Jember Regent was not much different from the views of the other seven factions.
“There are too many facts of failure, violations and the chaos of running the government,” he said.
The last failure, stressed Edi Cahyo, was the BPK’s assessment of the Jember regency’s financial statements, namely the disclaimer.
For this reason, the PDI-P faction fully supports the HMP as a Decree of the District DPRD.
“Please ask the Minister of Home Affairs to dismiss Regent Faida from the post of Regent of Jember,” he said.
The PKB faction also gave eight notes that were not much different from the other factions.
One of them is the policy of procurement of goods and services allegedly violating the provisions of Perpres number 16 of 2018.
“We ask the Minister of Home Affairs to implement regulations, impose severe administrative sanctions on the regent of Jember,” said PKB faction spokesman Sri Winarni.
While Regent of Jember Faida assesses the proposed right to express opinions not fulfilling the procedures as in article 78 paragraph (2) of government regulation number 12 of 2018.
In that rule, the proposal for the right to express an opinion (HMP) is accompanied by a document that contains at least the material and reasons for submitting an opinion proposal.
Then the material resulting from the implementation of interpellation rights and or questionnaire rights.
However, the Jember DPRD letter to the Regent of Jember to be present in giving his opinion at the hearing was not accompanied by supporting documents as required in article 78 above.
“Material documents and reasons for filing proposals for opinions have not been accompanied by losses to the regent,” Faida said in a statement sent to the Jember DPRD.
