A chicken was sacrificed as part of a ritual in the Congress of the Union. The presidency of the Senate of the Republic distanced itself from the incident and pointed out that the senator for the National Regeneration Movement (Morena), Adolfo Gómez Hernández, was directly responsible, who could be subject to a sanction.

Through a statement, the Senate assured that the Board of Directors denied the legislator access of any animal to the legislative precinct. However, the Morenista allowed the sacrifice of the bird under the justification of being “protected by the uses and customs of an indigenous group or community to which he expressed his self-assignment.”

Amid the wave of criticism against him, Adolfo Gómez insisted that the sacrifice of animals is part of the practices of indigenous peoples, who are under the protection of the Political Constitution of the United Mexican States.

“Even in Article 2 of the Constitution our free right is expressed, the practices of indigenous peoples must be respected. We rely on Article 2 of the Constitution,” declared the senator in a meeting with the press.

However, legislation in Mexico City prohibits the use of animals as part of traditional practices and contemplates sanctions against animal abuse.

Article 25, paragraph

While article 350 Ter of the Penal Code of the Federal District establishes that if an animal suffers injuries or death due to human action, those responsible are subject to sanctions, such as fines and imprisonment.

“Anyone who commits acts of mistreatment or cruelty against any non-human animal species causing their death will be sentenced to two to four years in prison and a fine of two to four hundred days, as well as the seizure of all the animals they may have. under their care or protection, in terms of the provisions of article 54 of this Code,” the aforementioned article states.

Adolfo Gómez Hernández assured that he was aware of the legal implications. However, he argued that he was protected by the second article of the Political Constitution of Mexico, which is superior to local regulations.

“There is a law superior to local law and I am referring to the second constitutional article, where the law expressly allows organization and respects the way of life of indigenous peoples,” he said in a meeting with the media.

The act of animal cruelty was reported by journalist Leticia Robles de la Rosa, who shared a video showing how one person holds a live bird, while another, dressed in traditional clothing, proceeds to decapitate it. After the act, the animal bled until the liquid fell into a clay pot on the floor.

This event took place in an offering ceremony as part of Earth Day (Tláloc), organized by Senator Adolfo Gómez Hernández, from the Morena parliamentary group, on the second floor of the Senate premises.

The event soon sparked criticism from senators from the Morena party and opposition legislators alike, including Morena member Ricardo Monreal and Kenia López Rabadán, senator for the National Action Party (PAN).

“We in the parliamentary group urged him not to do it, in the Morena parliamentary group the majority did not agree, it was not an agreement but a personal decision of the senator. “I personally do not agree with the sacrifice of any animal anywhere, I am an animalist and I believe in life and that is why I do not agree, even when it is treated as the allegation of uses and customs of the native peoples,” Monreal assured the press.

Meanwhile, López Rabadán attacked Morena for what happened: “This is Morena. Death and destruction. Putting the image of death and now killing animals describes this government. “Mexico must be the Country of Life, Happiness and Reconciliation among all.”
