They condemn the Balearic Government to compensate a taxi driver for an accident

The Contentious-Administrative court number 3 of Palma has condemned the Ministry of Territori, Energy and Mobilitat of the Balearic Government to compensate with 17,273.35 euros to the owner of a taxi in Ibiza who on September 15, 2009 suffered an accident in the Airport road caused by flooding that was not signposted.

The plaintiff filed the appeal after a claim for patrimonial responsibility before the Consell d’Eivissa was inadmissible for lack of passive legitimacy of the defendant administration.

Later, the affected party complained to the conselleria responsible for the highway, the E-10, which should have marked the incident in the tunnel.

Flooded road

The factual background indicates that the Civil Guard report shows that the “damage to the vehicle as a result of the flooding is attributable to the Administration.”

In addition to repairing the damage, the owner of the vehicle also claimed loss of earnings “due to failure to obtain the profits from the taxi.”

He also denounced the attitude of the Administration throughout the entire process, which, as he warned, was “disrespectful, as shown by the numerous vicissitudes that the case has gone through.”

In this sense, the plaintiff demanded compensation of 19,344 euros, according to the certificate issued by the Association of Autonomous Taxi Drivers of the city of Eivissa.

Against the sentence there is no longer possible appeal.
