These are the keys to the new public charge rule that goes into effect this Monday | Univision Immigration News

This Monday February 24th the new rule of public charge, a protocol that will regulate the way in which from now on the employees of the federal government of the United States will determine whether or not they grant a migratory benefit, for example: a visa, an extension of stay or a permanent legal residence (green card or green card).

The new policy changes for the first time a system that had been implemented since 1965, when the then president, Lyndon B. Johnson, enacted the Immigration and Nationality Law (INA), which regulates the immigration system and determines who are the foreigners who can enter and stay in the country, either as nonimmigrants or immigrants.

Until now, the process for obtaining a visa or residence includes demonstrating that the foreigner has the resources to pay his expenses and not depend on the government. But the new rule adds another set of factors in a new equation that includes, for example, age, health status or level of study.
