The trial between Twitter and Elon Musk is still ongoing, according to the judge

When it seemed that the novel between Elon Musk y Twitter could no longer add new chapters, after confirming that the entrepreneur wants to resume the purchase of the social network, the judge of the Federal Court of Delaware appeared on the scene. Justice Kathaleen McCormick assured that the process between the parties is still in place and that he has not yet been informed of the contrary.

so indicated in a letter who was released on Wednesday morning. “The parties have not filed a clause to suspend this action, nor have none of the parties requested the suspension. Therefore, I continue to move towards our trial which will begin on October 17, 2022,” he explained.

Logically, the situation can change dramatically in a matter of days, as long as Elon Musk and Twitter take the initiative to drop the lawsuits against each other. It will be necessary to see if this will happen in the next few days, considering that there are less than two weeks before the formal start date of the judicial appointment.

It is worth noting that tomorrow, Thursday, Elon Musk is expected to answer questions about the purchase agreement. The statement was originally scheduled for September 28, but the tycoon canceled it by claiming the fear of contracting COVID-19, since one of Twitter’s attorneys had been exposed to the disease. The legal team representing the social network did not hide their discomfort with this situation and accused the entrepreneur of avoiding the meeting.

It is not yet known whether the meeting will take place or not; but given yesterday’s news, it wouldn’t be strange if it was canceled again.

Elon Musk and his change of mind to buy Twitter

When it became known that Elon Musk had changed his mind and was intent on resuming the purchase of Twitter, the prevailing opinion among analysts was that, most likely, he would have concluded that he had little chance of winning the trial against the social network.

However, the CEO of Tesla and SpaceX chose to justify the situation from another position. In a tweet, he assured that Twitter will actually help accelerate the development of “X”, a supposed all-in-one app. An argument that doesn’t sound very convincing, at least for now. We will have to see how it matures over the weeks.

Regarding the trial, Elon Musk’s lawyers have communicated to Twitter their intention to resume the purchase for 44,000 million dollars respecting the original terms. But they made it a condition that the social network drop the case against the entrepreneur in the Federal Court of Delaware.

Judge McCormick’s letter not only states that, for now, the trial between the parties is still ongoing. The magistrate also claims that he believes Elon Musk used Signal e did not deliver all chats in which it referred to the transaction with third parties, as ordered.
