The new program was prepared by the climate department and the National Fund for Environmental Protection and Water Management. The goal of the program is to support home installations that will allow greater retention, capture and use of water, e.g. from rainfall, so that it does not go directly to the sewage system, drainage ditches, etc. “My water” will be implemented in 2020-2024, however, as the Ministry of Climate notes, the program will include costs incurred from June 1 this year. The call for proposals under the program will be conducted from July 1 by voivodship environmental protection funds. The budget of the program is PLN 100 million, and financial support will be implemented in the form of subsidies (cost reimbursements). Co-financing will reach up to 80 percent. eligible investment costs, but not more than 5,000 zł. The funds will be intended for owners of single-family homes.

What will you get support for?

The Ministry of Climate explains that support in the program was envisaged for the purchase, assembly and commissioning of installations allowing for the use of rainwater and snowmelt on the property. The following will be refunded: purchase of drainage pipes collected from gutters, inlets to the above-ground tank, underground tank, pond, draining installation; purchase of underground or aboveground storage reservoirs underground or aboveground; drainage installations and irrigation elements. Co-financing will also be granted in the case of the construction of a pond.

The ministry has clarified that money from the program will be due for above-ground open storage reservoirs from two thousand liters of capacity (over 2 cubic meters). For closed above-ground ones it will be above 1,000. liters, and underground ones from 2 thousand. liters.

According to the ministry’s calculations, the new program will finance 20,000 backyard retention installations, thanks to which it will be possible to keep 1 million cubic meters. water per year at its place of precipitation.

Legal issues

The Ministry also informed that rainwater retention and retention systems supported in “My Water” and implemented in private areas will not be included in inland standing waters, which means that there is no right of pre-emption of these properties by the State Treasury in the event of their sale. Pursuant to the Water Law, in the case of the sale of real estate covering land under inland standing waters, the State Treasury has the right of first refusal. Inland standing waters are defined as waters in lakes and other natural water reservoirs not directly connected in a natural way to surface inland flowing waters. The Ministry added that, although the waters in the depressions of the area resulting from human activities, which are not ponds, are not inland standing waters, the Water Law treats them as inland standing waters. “At the same time, when interpreting concepts under Water Law, one should be guided not only by linguistic interpretation, but also by purposeful and functional interpretation. In this context, waterholes can be considered as retention devices. Thus, Article 23 (2) of the Water Law, in which about depressions of land created as a result of human activity, it does not include waterholes, because these ponds as water devices are devices or structures, not depressions “- the ministry pointed out. He added that, therefore, waters in ponds could not be considered inland standing waters, nor could Art. 23 clause 2 Water Laws. “As a consequence, it should be recognized that the right of pre-emption by the State Treasury does not apply to ponds when they are sold” – it was emphasized.
