Faced with the absence of the teachers, more than one hundred requests were submitted to obtain compensation of 50 euros per day not replaced and 500 euros for non-pecuniary damage.

Taking legal action against national education as a last resort. In this school, it was not possible to replace a teacher last year. A student’s mother decided to file a compensation claim with the ministry: “As a mother, I had no solution for my daughter who was in CE2 and who for seven weeks had no master or mistress in front of her”. With this request, the parent of a student can ask the State for 50 euros for each day of lessons not replaced and 500 euros for non-pecuniary damage.
In order for the state to finally provide solutions, parents from all over France have submitted requests. 121 have been subjected to the ministry, but this is only the beginning. “Treating this topic with thousands of practices will allow us to react and thus to achieve the implementation of real state solutions”, explains teacher Joyce Pitcher, attorney for the students’ parents. The ministry has two months to respond to requests. Failing this, the lawyers will go to the administrative court of each academy.
