The Geprek Bensu brand is being sued again, this is what Ruben Onsu’s attorney says

JAKARTA, KOMPAS.com – After suppressing, now comes another lawsuit about food trademarks Geprek Bensu.

Name dispute between artist-owned businesses Ruben Onsu with entrepreneur Benny Sujono this has been going on since 2018, but was completed in 2020 after going through a trial.

However, it is known that PT Ayam Geprek Benny Sujono filed a new lawsuit to the Central Jakarta Commercial Court with case number 32/Pdt.Sus-HKI/Merek/2022/PN Niaga Jkt.Pst.

When asked about this, Ruben Onsu’s attorney who used to handle the Geprek Bensu brand dispute case, Minola Sebayang, gave an answer.

“For the previous case, it has been completed, yes, but regarding this new lawsuit there has been no discussion with Ruben, so I also can’t say anything,” said Minola Sebayang, Thursday (14/4/2022).

Minola Sebayang said that he was aware of the new lawsuit.

However, he insisted that Reuben had not yet communicated with him about this matter.

“Haven’t spoken to me yet, haven’t spoken,” said Minola again.

When Kompas.com tried to contact Ruben Onsu regarding the new lawsuit, the phone line was cut off.

Initially, two entrepreneurs from PT Ayam Geprek Benny Sujono, Yancent Kurniawan and Stefani Livinus, founded I Am Geprek Bensu in April 2017.

They asked Jordi Onsu to be the operations manager.

Jordi then offered his brother, Ruben Onsu, to be a promotional ambassador which the owner finally agreed to.

However, the two parties later broke up.

Ruben opened a restaurant with the name Geprek Bensu.

In June 2020, the Indonesian Supreme Court (MA) acknowledged and determined that PT Ayam Benny Sujono was the first and legal owner of the I Am Geprek Bensu brand.

In October of the same year, Benny Sujono as the owner of the “I am Geprek Bensu” brand sued the Director General of Intellectual Property (KI) of the Ministry of Law and Human Rights of the Republic of Indonesia (Kemenkumham).

The reason is that the Director General of KI is considered to have issued a letter to delete registered trademarks, namely PT Ayam Geprek Benny Sujono and Yangcent.

Meanwhile, his party has won the trademark dispute trial in the Supreme Court.

Referring to the Supreme Court’s decision, he continued, the Director General of KI should only cancel the geprek chicken brand registered under the name of Ruben Samuel Onsu or Ruben Onsu.

After that, in April 2022, PT Ayam Geprek Benny Sujono filed a lawsuit to the Central Jakarta Commercial Court with two defendants, namely Ruben Samuel Onsu as Defendant I and the Ministry of Law and Human Rights as Defendant II.

The plaintiff asked the court to punish Defendant I to pay compensation to the plaintiff in the amount of Rp 100 billion.
