The EC has sued Poland and the Czech Republic to the CJEU regarding the recognition of professional qualifications

The European Commission referred on Thursday 2 July to the Court of Justice of the EU cases against the Czech Republic and Poland regarding violation of EU regulations concerning professional qualifications.

The Commission considers that the national laws of both countries violate EU legislation, including regulations regarding the temporary provision of services and specific requirements for certain healthcare-related professions (Czech Republic and Poland) or for specialists (Czech Republic).

In the provisions on the recognition of professional qualifications, the EU has introduced a new system for the recognition of professional qualifications and experience throughout the EU. The assumption is the automatic recognition of professional qualifications in EU countries, which makes it easier for specialists to provide services throughout Europe, while guaranteeing a high level of consumer protection.

The EU directive concerns the so-called regulated professions such as nurses, doctors, pharmacists and architects. The exceptions are professions regulated by specific EU directives, e.g. auditors, insurance brokers, air traffic controllers, lawyers and sales representatives. The directive also sets out rules for temporary mobility, opening a business in another EU country, various systems for the recognition of qualifications and for checking language skills and professional titles.
