Constitutional Court (MK) finally rejected the judicial review of the presidential threshold proposed by Yusril Ihza Mahendra as the Head of the United Nations, Chairman of the DPD La Nyalla Mattalitti. As a result, tickets for presidential candidates are only owned by political parties that have 20 percent of the seats in the DPR. The PBB and the DPD cannot run their own presidential candidate in 2024.

“Declaring Petitioner I (DPD-ed) cannot be accepted. Rejects Petitioner II (PBB-ed) in its entirety,” said Chief Justice of the Constitutional Court Anwar Usman reading the Constitutional Court’s decision broadcast on the Constitutional Court’s YouTube Chanel, Thursday (7/7/2022).

Case Number 52/PUU-XX/2022 was proposed by the leadership of the DPR RI, namely Aa La Nyalla Mahmud Mattalitti, Nono Sampono, Dr. H. Mahyudin ST. MM and Sultan Baktiar. The United Nations was represented by its chairman, Prof. Dr. Yusril Ihza Mahendra.

In his application, Yusril sued because the regulation did not prevent the United Nations from carrying out a presidential candidate.

“That as a political party participating in the election, Petitioner II should have the constitutional right to nominate a Presidential and Vice-Presidential Candidate as stipulated in Article 6A paragraph (2) of the 1945 Constitution. However, this right has been reduced due to the enactment of Article 222 of the Election Law which adds a requirement for the acquisition of as many votes as 20%. This is contrary to what is stipulated in Article 6A paragraph (2) of the 1945 Constitution,” said the UN in its petition.

The DPD stated:

Whereas the existence of the presidential nomination threshold as regulated in Article 222 of the Election Law has in fact been detrimental to the regions and has further widened the gap between the regions and the center. If you look back at history, the idea of ​​a presidential threshold is not a new issue, but has become a public discourse since 2003-2004 when the constitutional commission was working until the 2009 general election.
