the couple of men from whom the CAF asked for a pregnancy certificate rejected by the courts

This Monday, November 15, the Mulhouse court rendered its decision concerning a couple of men who had attacked CAF in court. Parents of a child born by surrogacy, they accused him of refusing them a birth bonus, on the pretext that they could not present a pregnancy certificate.

In September 2021, a legal battle began between two dads of a child born of surrogacy (GPA) in the United States and the Haut-Rhin family allowance fund (CAF). The latter refused to pay the gay couple a birth bonus he had requested.

The CAF justified this decision by the fact that the two married men were unable to present a pregnancy certificate, a compulsory document to benefit from the bonus. However, the surrogate mother to whom the couple had appealed in the United States does not appear in any document.

Considering themselves discriminated against, they had taken CAF to court, but did not win their case on Monday, November 15. The Mulhouse court dismissed them.

In this unfortunate story, everyone passes the buck and leaves a family to fight alone.

The homoparental couple did not want to comment on the court decision. However, the two men consider “inadmissible” to find themselves without an answer from the CAF du Haut-Rhin, and denounce the “lack of humanity” of the organism.

“In this unfortunate story, everyone passes the buck and leaves a family to fight alone”reacted one of the fathers. “CAF never called us, and never replied to a letter I sent in March”he regrets.

“They are however able to make a phone call, but we have no interlocutor! Why don’t we get an answer?”asks the dad, who also tried to join the cabinet of Adrien Taquet, Secretary of State for Children and Families: “Again, we have had no response. A few months before the presidential election, we are playing dead.”

The two men are waiting to receive the official letter which will specify the terms of appeal: “Depending on our desire, our means, and our motivation, we will draw our own conclusions”explains one of the fathers.
