The Baden-Württemberg Administrative Court in Mannheim said on Tuesday that the significant increase was legal. The norm control application of a Freiburg municipal council was thus rejected.

His urgent application had already been rejected in June. In addition to partially covering the costs, the legitimate purpose of the parking fee is to compensate for the special advantage for residents with cars – namely to use the public parking space without further fees or time restrictions, the court explained.

The fee regulation also aims to reduce car traffic in the city center and thus emit fewer greenhouse gases. With a view to the national climate protection goal and to protect fundamental rights from the dangers of climate change, this is permissible. The increase in fees is also proportionate because parking spaces in multi-storey car parks would incur significantly higher costs.

In December 2021, the Freiburg municipal council decided on a new fee schedule, which provides for an eight to 16-fold increase in parking fees, depending on the length of the vehicle. The rule went into effect in April. The plaintiff also challenged exceptions for the severely disabled and recipients of social benefits, which the Court has now also ruled to be lawful.

However, the judgment is not yet final. The appeal to the Federal Administrative Court was allowed.
