Daniela Rothenberger (62) paid dearly for her courage. The IV pensioner, who suffers from a mental impairment, made her wage cut public in the Villa Sarona in Chur. Her employer, the retirement home group Tertianum, had reduced her salary from CHF 500 to CHF 100 a month. Although the old people’s home receives CHF 264 from the social welfare office.
–
After the BLICK disclosure, the employer tried to prevent the publication. Overnight even switched on the Graubünden child and adult protection authority (Kesb) – and provided the employee with a supervisory provisional decision.
–
“My sister is not neglected”
A shock for Daniela Rothenberger, an absurdity for her brother Andrea (57). He now wants to report abuse of office against the Kesb. For him, the order against his sister clearly violated the proportionality. He knows: «My sister is neither neglected nor in any way conspicuous. She runs a household independently and cleanly. »
–
For a super-provisional decision, the Kesb must provide a justification, and the measure must be proportionate. Otherwise the decision is abusive. And the brother assumes: “For me it is clear: The Kesb has completely overreacted.”
–
This defended itself yesterday in the VIEW. Managing Director Giusep Defuns: «We are obliged to act on reports. Our experts will also take a close look to see if the employment relationship was correct. »
–
Tertianum says Sorry – and pays!
Daniela Rothenberger’s family doctor also confirms the image of a healthy and conscientious lady. In the VIEW certificate, it says: «I have always known her as a correct and reliable patient. With the help of relatives, she can fulfill her obligations. »
–
Today Daniela Rothenberger has a groundbreaking appointment with the Kesb: «It is decided whether I will be given permanent support. Of course I’m afraid that I’m saying something wrong. After all, my brother offered to step in as an assistant, that would be a little comfort. »
–
A little balm on the soul should be there that the old people’s home finally admits its mistake. Tertianum spokesman Andreas Bantel told BLICK: «Tertianum would like to apologize to Ms. Rothenberger. The wage cut is due to an internal error that the company has since corrected. Ms. Rothenberger will continue to receive the same wages of CHF 500 in the future. The wage cut of the past months will of course be refunded. » So Daniela Rothenberger’s courage paid off.
