Tas rejects the appeal and exacerbates the sentence – Corriere.it

The motorcycle career of Andrea Iannone probably arrived at the terminus. On Tuesday the Court of Sports Arbitration of Lausanne in fact imposed on him four years of disqualification (the maximum penalty provided for by the Anti-Doping Code) for the 1.15 nanograms / ml of drostanolone – anabolic steroid included in the S1 category of substances prohibited by the Anti-Doping Code – found in his urine on 3 November 2019 in Sepang, after the Malaysian GP. It closes on a sporting level a complex case, full of twists, including media and controversy.

Andrea Iannone – the referees write in the summary reasons for the sentence – claims that the source of the prohibited substance is the contaminated meat consumed in Malaysia before the Grand Prix. But the Tas scientific panel found that Iannone had failed to establish neither the precise type of meat he had consumed nor the origin of that meat. Furthermore, neither Andrea Iannone nor his experts were able to specifically establish that there was a problem of meat contamination by Drostanolone in Malaysia. This group considered therefore that a willful violation of the Code has been committed.

The conclusion of this Panel – continues the document – does not in itself exclude the possibility that Iannone’s positivity may be the result of consuming meat contaminated with Drostanolone but Iannone could not provide any convincing evidence to establish that the violation committed was unintentional.

Asked by the Corriere, Antonio De Rensis, head of the legal staff of the Abruzzese rider, spoke of sensational scientific errors in the reasons that will soon be revealed by us and our consultants and to appeal to the Swiss Federal Court within thirty days. An appeal that is formally possible (even if the TAS judge of last instance in sports) but which has a favorable outcome in a very limited number of cases. The outcome of the trial was deemed crucial by Wada who in the face of an unfavorable sentence, he would have seen all the jurisprudence on food contamination put into question.
