It’s a paragraph, no, actually just a sentence that causes panic. It is about the report on the Federal Corona Regulation. This should be brought into law in autumn. On page 10 of the explanation of the draft law it is written in black and white: The Federal Council should be able to make vaccinations compulsory.

This creates excitement. The Federal Council wants to introduce a vaccination requirement through the back door, reports the online portal “Inside Paradeplatz”. An online petition has been launched, the news spreads like wildfire on social media and WhatsApp (see photo).

However: the message is incorrect. It is correct that the Federal Council could already make vaccinations mandatory – at least in theory. This is already the case in the Epidemic Act that has been in force since 2016. But there will certainly not be a constraint.

The vaccination compulsory, which is mentioned in the said document, is therefore not something that the federal government plans to introduce because of Corona. Rather, it is a reference to the competences that the Federal Council already has.

Obligation does not mean compulsion
Accordingly, the Federal Council may make vaccinations compulsory in a “special situation” in which we are currently located. However, only for a limited time and only for people at risk or particularly exposed and for certain professional groups: for example for health workers.

It is also important that a mandatory is not the same as a compulsion: The Federal Office of Public Health has emphasized several times in the past that nobody should be vaccinated against their will. According to the Epidemic Law, there should also be no sanctions such as fines if someone refuses to be vaccinated. However, restrictions for non-vaccinated people are possible, for example that unvaccinated health workers are no longer allowed to work in certain departments. The federal government should only implement the measure after consulting the cantons.

Dispute already
The dispute over the vaccination question has already been fought. Namely, when the epidemic law was revised. Parliament clearly approved the revision of the law in 2012. It was due to opponents of vaccination that the result was a referendum. The referendum in 2013 was then clear, however: 60 percent said yes to the new law – and thus to the vaccination requirement under certain circumstances.
