The Senate room passed into law the bill that specifies the scope of the procedure of labor guardianship regarding the public workers.
In conditions of being promulgated into law, the project related to the scope of the procedure of labor guardianship. This, after the Senate Chamber endorsed with 29 votes in favor and 8 abstentions, the changes made by the Low camera.
This is the project that specifies that the labor protection procedure benefits all workers, including officials of the Public Administration, the National Congress, the Judicial Power, public companies, and workers of the Public Ministry, the Constitutional Court, the Electoral Service , Comptroller’s Office and the Central Bank.

It also modifies the Work code in terms of clarifying the scope of action of the Work address in matters of labor protection and clarifies the payment of compensation for public sector workers in case of availing themselves of the complaint for this reason.
Finally, it specifies that “if the judge declares that the dismissal of State Administration officials is discriminatory and, furthermore, this is classified as serious, the worker could choose between the corresponding compensation or his reinstatement to the position.”
Project was approved amid criticism and praise
In this regard, Socialist senator, Juan Pablo Letelier, appreciated this last change entered in the Chamber.
“The changes made by the Lower House seem appropriate to us, for example the fact that in the case of dismissal, workers can decide whether to return to their work or receive the corresponding compensation,” he said.
Less optimistic, the UDI Senator Luz Ebensperger, questioned the bill.
“I believe that this project violates norms that are the exclusive initiative of the President of the Republic because it changes functions and if it is approved it will involve fiscal spending. I am going to abstain because I think the presidential initiative is being invaded, “he added.
