Rodgau: Litigation with architect settled

Rodgau For years there was a dispute about the social building at Ludwigstraße 58 in Jügesheim. Now the city and the architect have agreed.

This building cost a lot of nerves for those involved: For years there has been a dispute about the social building at Ludwigstrasse 58 in the Jügesheim district of Rodgau; it was even processed. Tenants went to court against the city because of the high additional costs, an architect sued because the city had cut his fee. As First City Councilor Michael Schüßler (FDP) explained on Tuesday, this last legal dispute has now come to an end.

It was no coincidence that the city partially withheld the architect’s fee: Instead of ten percent less, the completion of the 20 barrier-free apartments for “seniors on a tight budget” ultimately cost around ten percent more. The cost estimate was 3.3 million euros, and after the tender, the building costs were only three million euros. But then came the nasty surprise: the construction company recognized a lot of defects and pointed out the city. “We were faced with 127 amendments to the construction work,” said Schüßler. The project ultimately cost 3.6 million euros.

In the legal dispute, which had been pending since 2015, the court now submitted a settlement proposal. The architect should pay the city 11,000 euros, then the dispute is settled. The judges assumed an open architectural fee of 72,000 euros, and 83,000 euros they recognized as damage to the city. “According to the court, the city received an equivalent for the other costs,” explains Schüler. The objection period against the settlement proposal is valid until June 30th. The magistrate has launched an urgent bill so that the city councilors can give their consent at their meeting on Monday.

In 2009 the planning of the new building with 20 residential units began, in 2011/2012 the building was hoisted, on January 1st 2013 the first tenants moved in. You still live there for 6.38 euros per square meter, only new tenants are now paying 7.24 euros per square meter – but still 15 percent less than the standard local rent. The city has learned from the quarrels about social housing: it now awards the construction work in individual trades and no longer to general contractors.
