Rent regulation: the first fines against landlords fall in Paris

The rental framework has been put in place in Paris since July 1, 2019. According to the law for the development of housing, development and digital (ELAN law) of November 23, 2018, an administrative fine may be imposed by the prefect if an owner does not respect this rent framework. This is what happened for the first time for five Parisian owners, reveals The world. Four family SCIs and one natural person had exceeded the legal rents, for monthly amounts of between 63 and 335 euros.

These rents concerned four studios and a two-room apartment located in the 7th, 10th, 11th, 13th and 18th arrondissements in the capital. These five owners had been put in default, but did not rectify the situation by bringing the rent back to the legal level and by reimbursing the tenant for the overpayment. It is not specified whether the prefect took charge of these files or whether the tenants are behind this process. While the administrative fine could climb to 5,000 euros, these owners were ordered to pay between 300 to 1,090 euros each by Marc Guillaume, prefect of Ile-de-France, who pronounced these sanctions on August 17 (for two owners), September 21, October 2 and November 23.

According to Le Monde, 75 tenants have already entered the rent conciliation commission since July 1, 2019, as the law allows them to do. For 49 of them, a conciliation was found with the owner and they benefited from a reimbursement of the overpayment. About thirty cases are still being processed. As the City of Paris explains on his website, an interactive map shows the reference rent for housing in the capital. The rental framework “applies to leases signed since July 1, 2019 and the three types of reference rents are set annually by an order of the prefect: a reduced rent (equivalent to the reference rent -30%), a rent reference, an increased rent (equivalent to the reference rent + 20%) ”, also reminds the City of Paris on this subject.
