The fund was included in the Draft Labor Law prepared by the Scientific Committee in 2001.

The draft law on severance pay fund prepared by the Scientific Board was brought to the agenda in June 2002. According to the draft, the fund would be a public institution affiliated to the Ministry of Labor and Social Security, subject to private law provisions, financially and administratively autonomous, with a private budget and legal entity.

The Fund Board of Directors will consist of a representative to be appointed by joint decree upon the proposal of the Minister of Labor and Social Security, and a member selected by the confederation of the workers representing the most employers, and two selected by the employer confederation. This draft prepared by the Scientific Committee in 2002 was put on the shelf especially due to criticisms from the workers.
