Property Owners in Nessebar’s “Kokalu” Area Forced to Remove Structures as Municipality Begins Infrastructure Projects

In Nessebar, property owners in the “Kokalu” area will have to remove parking lots, swimming pools, fences, gazebos and playgrounds from private land, because the municipality is starting to build infrastructure. According to the PUP for the area adopted in 2019, a street must pass through the private lands, and in other places an extension of an already built road is planned again at the expense of private property. The municipality does not see a problem in the prepared regulation, but due to the complaints of property owners, cases have already been filed in the Administrative Court in Burgas. There were protests in front of the municipality. The municipal administration emphasizes that the concept of “legalization” is missing from the current legislation. The opinion says that the municipality followed all procedures for approving the PUP, which came into force after the only 2 appeals against it were rejected by the Court of Appeal. We wrote about the case in FACTS, and here is the development after Radost Marinkova contacted us again. We have sent an inquiry to the municipality of Nessebar, and here is their answer.

– Mrs. Marinkova, what’s new with the PUP, which is for the “Kokalu” locality in Nessebar?
– We already have a registered association of the affected owners. It is about more than 300 people. We have had protests, there will be new ones. We want a meeting with the Minister of Regional Development and Public Works to introduce him to the case. We will apply civil pressure to change this PUP.

– Conversations with the municipality…
– None. They cling to the transitory statement that everything is according to the law. How is it according to the law since we were not notified. On Monday we will have a meeting with the ombudsman of Burgas. We will not stop until we protect our rights as owners.

– What is happening in the Kokalu area?
– On October 20, notices were pasted to us that the removal of a wall, fences, etc., would soon begin. There is no dialogue to resolve the issue. Therefore, there will be public pressure and more protests. Well, today (year-yesterday) we got together again.

– You are protesting and what…
– Our protest in front of the municipality was not political, but we are doing it now because it will be heard the most.

– But this development plan has been adopted…
– This PUP was adopted without public discussion and damages our properties. And by the same administration, which years ago accepted the construction of the houses as complete and legal. How come years later someone decides something else and does it, but without letting us know. It concerns property owners in two neighborhoods. There are foreigners – English, Danes, etc. People wonder how all this is possible.

The municipality of Nessebar refuses to talk to the owners of the affected properties. Due to the tension that arose, the municipality published a statement on its website stating that the objects to be removed – fences, pools, gazebos, parking lots, playgrounds and park landscaping – do not have the necessary project documentation and building permits, which classified as “illegal constructions”.
