The Braga Court acquitted a man tried for trying to kill another after an argument in Vila do Conde. The judges considered that there was no evidence that he fired, three meters away, into the body of the complainant, his former friend, giving only as shown that he fired two shots but into the air. They also concluded that he was not drunk when he pulled his pistol.
The two were daily friends but caught up of reasons because of a bitch. Jose Maria C., pulled his pistol and tried to kill his friend. He was tried for attempted murder, prohibited gun possession, and use and possession of a gun while intoxicated.
The 65-year-old defendant from Famalicão made friends in 2014 with Ricardo P., who was a neighbor in Grimancelos, Barcelos. They ate meals together and deprived themselves frankly.
Jose Maria had a dog of the breed Chow chow, and Ricardo’s girlfriend, Ana, offered him a dog of the same breed, and it was agreed that he would give her a puppy when they were born.
In the meantime, the defendant moved to Caxinas, Vila do Conde.
In March 2017, and since he did not fulfill his promise to give her a baby, Ricardo, accompanied by Ana and a cousin, sought him out at home; peered through the wall and was confronted by the defendant: “Get out of here. I don’t want you here! ”I told him. To which Ricardo replied: “I am on the public road”.
Revolver pull
In response, Jose Maria – the prosecution said – slapped him in the face and, in the middle of shoving, headed for the car with a revolver, a Magnum 7.65 caliber mm: “Don’t get out of here, get out of here!” He shouted, firing a shot from three meters away that just didn’t hit his former friend “luckily”. This has not been proven.
The confrontation continued with Ricardo grabbing his hands and knocking him over, which he managed even though there was still a shot in the air. Then his cousin and his girlfriend eventually immobilized the perpetrator, taking his weapon away.
Called to the site, the GNR found that he was drunk with 1.77 grams per liter of blood.
