Polkomtel, network operator Plus, must pay a fine of PLN 39.5 million. This is the result of a decision issued by the Court of Competition and Consumer Protection after an appeal lodged against the decision UOKiK issued in 2019, the Office found that Polkomtel unlawfully charged fees in excess of the subscription fee for nine automatically activated services, such as “Czasoumilacz” or “Display Service”.

UOKiK argued that the provisions of the Act on consumer rights require the entrepreneur to obtain the customer’s express consent for each additional payment before signing the contract. – Polkomtel did not have such clear consents from consumers. Information on ordering the activation of these services and fees for them was included in documents separate from the contract, i.e. promotion regulations, said the then head of the Office, Marek Niechciał.

In the opinion of UOKiK, when signing the contract, the client also accepted the content of the general statement indicating that he had read the documents constituting the contract. – As the complaint shows, some consumers were not even aware that they were paying extra every month – explained Marek Niechciał.

On Tuesday Office of Competition and Consumer Protection informed on a judgment in a similar case. The Court of Appeal dismissed T-Mobile’s appeal from the decision and ordered the payment of PLN 15 million “for launching additional paid services for customers, for which they did not expressly consent to it,” we read in a short statement published on Twitter.
