Partial Implementation of Animal Welfare Law: Dog Ownership Insurance and Responsible Ownership Course Postponed

The Animal Welfare Law will come into force on the 29th, but not in its entirety. For the moment, it will not be mandatory to take out dog ownership insurance (except for potentially dangerous breeds) or take the course on responsible ownership of dogs and cats. These, points 30.3 and 26.8 respectively, will remain in the air until the Government is formed, since their interim status does not yet allow the regulation of the law to be approved.

The ministry indicates that the draft regulation has already been prepared but will not be known until it can go to the Council of Ministers. This will not happen while the Government is interim, because the acting Executive cannot approve a rule of this type. Thus, from the department headed by Ione Belarra, they trust that it will be approved as soon as the new government is formed.

From Social Affairs and Agenda 2030 they point out that the obligation to contract and maintain in force civil liability insurance by natural or legal persons who own dogs, which had to come into force on September 29, “in purity of legal terms , is not effectively applicable until the regulatory development of said precept occurs.

However, regarding this type of civil liability insurance, the Ministry reminds that regional and local regulations must be complied with, which, in some cases, already establish the obligation to have this insurance. In the case of Gipuzkoa, at the moment only breeds considered potentially dangerous are required to have this insurance.

Consult policies

In insurance for dogs that appear on the ‘dangerous’ list, specific regulations require that the minimum civil liability insurance coverage be at least 120,000 euros.

It is important to consult insurance companies for advice on dogs, since they could be included in home insurance policies, depending on their type, applicable regulations and other aspects.

If not included, this civil liability insurance can be requested as an extra. The other possibility is to take out specific insurance for pets, which also offer a greater protection service such as health care.

The completion of the responsible ownership course and the identification of animals on the positive list are also postponed

In the case of Mapfre, “if you have home insurance, you have civil liability coverage for animals included in the policy,” says Jon Albert Vázquez, Mapfre client advisor in Donostia. “The sum amounts to 40 or 50 euros per year, and there are discounts for having several animals.”

If you do not have home insurance, this policy can be purchased through a separate service at any office or online. “The policy covers up to 60,000 euros, extendable up to 300,000 euros.” This will happen in the event of an accident, damage, or even theft of the pet.

The completion of the responsible ownership course will await the approval of the regulations, as well as the identification of animals included in the positive list, other than the dog, cat and ferret species. Invasive species of exotic mammals will be listed to preserve native fauna and flora.
