Yesterday evening, at the foot of the municipal house, Francesco Siani celebrated with toasts and fireworks the sentence published in the morning by the judges of the Second Section of Salerno (president Nicola Duranteextender Olindo Di Popolo) of the Regional Administrative Court, which have protected the precarious position of the owners of the controversial off-market parking spaces.
«It is undeniable that the provision integrates the specific details of the concession for use of the public area»: the words of the robes, referring to the authorization issued to the holder of the “Svalvolato on the road” in July 2022, they are a tombstone on the interpretation of the majority that supports the mayor Cecilia French and the manager of the branch, Giuliano Caso. The ten-page verdict by which the TAR accepts the appeal brought by the entrepreneur, assisted by the lawyer Francesco Avagliano, clarifies that the licenses for temporary employment issued to street vendors perpetually on the grill are comparable in all respects to concessions. And as such, with all due respect to the leaders of the Palazzo di città (sponsored by the lawyers Saturday Criscuolo ed Ennio De Vita) can fully benefit from the advantages brought about by the sixth paragraph of article 11 of the Annual Law for the Market and Competition 2022: in other words the effects of the precarious concessions (because, as ruled by the judges, that is what it is about) can be extended until 31 December 2025.
