The Transport Department will implement new arrangements for “vehicle searches” starting next Monday, including clarifying the purpose of establishing a vehicle register, specifying the conditions for issuance of a certificate of vehicle registration details, and introducing an “exceptional circumstances” application mechanism.
The Transport Department stated that the Court of Final Appeal’s earlier judgment on a related case pointed out that personal data in vehicle registrations involves privacy and the Commissioner has the responsibility to ensure that it is handled properly to minimize the risk of data misuse. The Department has completed a review program.
Director of Transport Li Chung-yan emphasized that “news reports” are not the main consideration for establishing the register. He understands that there are always some situations that do not fall under the “specified purposes” but involve significant public interests, so he has launched an “exceptional situation” application channel. There is no broad definition of significant public interest that applies to all situations. The decision depends on the content of the application submitted in different cases, and other departments will be consulted if necessary.
The Transport Department pointed out that the purpose of establishing the register is to regulate the use of vehicles, for law enforcement agencies to perform their duties, and to provide information to persons who are directly affected by the ownership or use of vehicles and who want to ascertain the information of the vehicles. To meet the conditions for issuing a certificate, it must be used for 7 “specified purposes”, including the purchase and sale of vehicles, insurance claims and compensation claims, etc. Applications for “exceptional circumstances” need to involve vehicle ownership or vehicle use, and involve significant public interests.
