The European Commission is still issuing opinions on the Polish National Reconstruction Plan. It assumes obtaining approx. PLN 24 billion euro in the form of grants and approx. EUR 12 billion in cheap loans, with the possibility of a possible “borrowing” of another EUR 22 billion. The plans of four more EU countries – Croatia, Slovenia, Lithuania and Cyprus – are to receive the green light from the Council of Ministers of Economy and Finance of the EU countries (ECOFIN) on Monday, July 26.

Formally, the European Commission has until August 3 to evaluate the Polish reconstruction plan. Only that, as he writes “Dziennik Gazeta Prawna”, probably ECOFIN will meet again only in September. This means that the disbursement of funds for Poland will be delayed by several months.

As reported by DGP, there is a belief in the United Right camp that Brussels uses the Polish reconstruction plan to “motivate” Polish authorities to implement the ruling of the Court of Justice of the European Union regarding the Disciplinary Chamber of the Supreme Court.

The judgment of the CJEU and the KPO are “parallel cases”

Officially, the deputy head of the European Commission, Vera Jourova, says that the decision on the KPO issue “is a parallel matter” that “is not related to the CJEU judgment issue.” At the same time, however, he emphasizes that Brussels “must have guarantees that the interests of companies will be equally protected in all countries”. Poland’s ignoring the judgments of the CJEU regarding the Disciplinary Chamber of the Supreme Court or the mine in Turów certainly does not build such confidence in Brussels.

On the other hand the correspondent of “Deutsche Welle” Tomasz Bielecki points out that the president of the European Commission Ursula von der Leyen is not planning to travel to Poland before the deadline for agreeing the KPO. Meanwhile, so far, approval of all 18 plans has been announced in the capitals of individual EU countries.

Bielecki, referring to his sources in Brussels, explains that “if Warsaw would already give very convincing signals of concessions on the primacy of the CJEU within days, then perhaps the KPO cases would be unblocked very quickly.

Will there be a reform of the Disciplinary Chamber?

The details of the planned solutions are not yet known. According to “DGP”, it is considered:in. liquidation of the Disciplinary Chamber of the Supreme Court or change of the method of appointing judges sitting in it.

We can find solutions that will change everything, not to change anything. The rules of operation of these entities can be changed in such a way that the CJEU and the European Commission have to initiate further proceedings. Over and over again

The European Commission ordered Poland to implement the CJEU ruling on the Disciplinary Chamber by August 16. If it fails to do so, the Commission will apply for a financial penalty.
