VERBANIA – Under house arrest Gabriele Tadini, released from prison Luigi Nerini ed Enrico Perocchio: at 11.15 pm on Saturday evening the decision of the investigating judge arrives on the arrest of the three suspects for the accident of the Mottarone cable car.

After less than 96 hours, all three leave the Verbania prison and only the head of the cable car will continue their detention at home.

The investigating judge Donatella Banci Bonamici he does not believe that there are sufficient elements for the three suspects to remain in prison for complicity in multiple manslaughter and very serious negligent injuries, forgery in public deed and willful removal of the security systems of the investigation into the Mottarone disaster with the decision by which does not validate the arrest decided by the prosecutor in the early hours of Wednesday.

These are the statements of Tadini (here the minutes) a not be deemed credible with those of other employees who said that the choice to put the forks, the blocks that made the brakes ineffective and did not avoid the accident was known, explains the Prosecutor of Verbania, Olimpia Bossi. The magistrate adds that, instead, Nerini and Perocchio were believed who have discharged all responsibility on Tadini. The Prosecutor warns that the proceeding is in its initial stages and that the causes and responsibilities of the breaking of the hauling rope that triggered the disaster.

The Mottarone cable car and the accident: the latest news

The defenders are satisfied. Justice was done with the release of my client, but we must not rejoice because those responsible have yet to be found, says the defender of Nerini, the lawyer Pasquale Pantano. Professionally for me a satisfaction. I only asked for house arrest because the brake lock issue is certainly his fault, he says Marcello perillo, lawyer of Tadini. For Perocchio’s lawyer, Andrea Da Prato, the judge ruled that the detention was forced.

The validation hearing begins in the morning with the suspects answering the questions. an all against all. The owner Luigi Nerini says that he has nothing to do with safety, so the accident is the fault of the operating manager and the head of the service; the manager of the Perocchio who declares that he did not know about the forks that the head of service had put; the head of the service Tadini who admits to having put them himself, but says that it was the company, therefore Nerini, who wanted them so as not to interrupt the service, with the awareness and approval of Perocchio. They were installed on the day of the accident and at other times due to problems with the brake control unit which – specifies the lawyer Perillo – are absolutely not connected to the breaking of the rope, whose origin is unknown. If he had imagined any danger, he would never have allowed the passengers to board.

No admission from Perocchio. The only element against him – says the lawyer Da Prato – a brief, generic and superficial statement by Tadini that says that Perocchio was aware of the presence of the forks. There is no trace of this communication, of when and how he did it. The investigating judge believed him.

For the prosecution Nerini had an operational role in the cable car and, therefore, knew about the stops. By law – argues the lawyer Pasquale Pantano – only the director of the service and the head of service can stop the plant. The security entrusted to them, not the business of the merchant Nerini.
