Magdalena A. accused of filing false tax returns

The prosecution brought indictments to the court against five people, including the PO MEP and the widow of the murdered Gdańsk president Magdalena A. and her mother, the Polish Press Agency in the National Prosecutor’s Office found out on Friday. MEP is accused of filing false tax returns.

According to the information provided by the National Prosecutor’s Office, Magdalena A. – the wife of the deceased president of Gdańsk, and currently a member of the Civic Platform MEP – was to conceal nearly PLN 300,000 and PLN 100,000 of income in tax returns for 2011-2012. The prosecutor’s office also accuses her of failing to account for income from renting flats as conducted in the conditions of non-agricultural business activity. According to investigators, the tax reduction was almost PLN 120,000. Such acts are punishable by a fine or imprisonment.

The MEP’s mother was supposed to give false testimony

The prosecution also covers Janina A., the mother of an MEP. The prosecutor’s office accused her of giving false testimony in the investigation of irregularities in the property declaration of the President of Gdańsk murdered 1.5 years ago and in criminal proceedings. According to the investigators, during the interrogation, the woman gave false testimony as a witness that the MEP’s grandfather had hundreds of thousands of zlotys in savings, which were to be transferred to Paweł and Magdalena A. as a donation. The prosecutor’s office indicated that, in fact, the MEP’s grandfather did not have significant assets.

Two businessmen with corruption charges

According to PAP on Friday, the prosecutor’s office also includes two businessmen accused of corruption offenses. The findings of the investigators show that the men sought to change the local spatial development plan in Gdańsk, which assumed urban solutions unfavorable for the investor.

According to investigators, during the accelerated procedure for changing the spatial development plan, the president of Gdańsk and his family members bought three apartments at reduced prices. “In relation to the mayor of Gdańsk and his family members, the investor applied much lower prices for the purchase of flats compared to other clients purchasing premises as part of the investment in Gdańsk – Jelitkowo, which resulted in a property benefit of almost PLN 350,000” – the prosecutor’s office reported.

Investigators indicated that the prices of the purchased apartments were contrary to the sales policy and price list assumptions, and were unjustified due to the great interest in these properties among customers. The prosecution emphasized that the buyers of other apartments paid much higher amounts and, despite similar purchase circumstances, did not receive such significant discounts as the president of Gdańsk and his family.

The allegation of exceeding the rights of a local government employee

In this case, a local government employee who was accused of exceeding official powers in order to gain financial benefits was also accused. According to investigators, the man acted for the company represented by the co-accused businessmen. The official’s actions were to be associated with the failure to pursue a penalty for, inter alia, delays in handing over forty-seven apartments to the city of Gdańsk.

As emphasized by the prosecutor’s office, the Gdańsk authorities did not take any steps to obtain the contractual penalties. It concerns the amount of PLN 1.3 million for the failure to hand over the residential premises on the agreed date and PLN 10 million for the failure to conclude a land exchange agreement within the prescribed period.

In January 2019, the then president of Gdańsk was attacked with a knife on the stage of the finals of the Great Orchestra of Christmas Charity by 27-year-old Stefan W. As a result of the attack, the local government official died. Earlier, a second trial was pending before the Gdańsk district court, in which the president was accused of providing false data in asset declarations in 2010-2012. Due to his death, the case was discontinued.
