Lawsuit for ‘toxic substance’ in Skittles | Financial

Titanium dioxide will soon be banned in the European Union because it could cause damage to DNA, brains and organs. The substance is according to consumers who have gone to court in Oakland, California, “a known toxic substance” and conclude that the colorful candies are “unfit” for consumption.

In the United States, however, health authorities still call titanium dioxide safe, as long as a product contains no more than 1% of the total weight. Candy maker Mars announced in 2016 that it would stop using the substance in Skittles, but the complainants still use titanium dioxide.

Not warned

The complainants’ lawyers also argue that Mars has also been negligent in warning consumers of the dangers. Mars points out in a statement that the use of titanium dioxide complies with the rules of the food and drug administration. The company also declined to comment on the lawsuit.
