Korea Introduces ‘Life Imprisonment Without Parole’ for Heinous Crimes: Minister of Justice Han Dong-hoon

In order to strictly respond to heinous crimes, a new ‘life sentence without parole’ will be established.

The Ministry of Justice announced on the 11th that it would announce the legislative notice of the amendment to the Criminal Code from the 14th of this month to the 25th of the following month.

According to the amendment, life imprisonment is divided into life imprisonment for which parole is permitted and life imprisonment for which parole is not permitted.

In the case of a sentence of life imprisonment, the court must decide whether or not parole is permitted, and parole is allowed only if the sentence is sentenced to life imprisonment for which parole is permitted.

The current criminal law adopts only ‘relative life imprisonment’, which stipulates that parole can be granted if certain conditions are met even in the case of life imprisonment.

Currently, parole is possible after serving 20 years of imprisonment if the prisoner’s attitude is good and there is clear remorse.

Under the current law, the only punishment more severe than life imprisonment is the death penalty.

However, since Korea has not carried out the death penalty since December 1997, there is a gap in execution, so the Ministry of Justice’s position is that it is necessary to create a ‘life sentence without parole’ to enable gradual punishment according to the nature of the crime.

Recently, the Supreme Court also said, “It is not appropriate to impose the death penalty to achieve the effect of absolute life imprisonment, which is not in the law,” and expressed the need for the introduction of life imprisonment without parole for permanent isolation of heinous criminals.

Justice Minister Han Dong-hoon said, “If life imprisonment without parole is introduced, it will be able to operate as an effective system to permanently isolate violent criminals from society.”

The Ministry of Justice plans to finalize the revised bill after collecting opinions during the legislative notice period.
