Former Attorney General Erik Kalnmeier may have to appear in court for unauthorized disclosure. The Corruption Prevention and Combating Bureau (KNAB) has sent a case to the Prosecutor’s Office separated from another criminal proceeding, in which, according to unofficial information available to Latvian Television (LTV), it urges Kalnmeier to be accused of leaking information in a Jelgava prosecutor’s bribery case.

IN SHORT:

  • LTV: KNAB urges to accuse Kalnmeier in connection with information leak in the bribery case of Jelgava prosecutor.
  • Neither Kalnmeiers nor the other participants in the proceedings comment on their connection with what happened, nor do they deny it.
  • The prosecutor’s office will now have to decide whether to prosecute.
  • Prosecutor General Stukāns: there is no reason to question the suspicions expressed by KNAB.

News that KNAB detained one of the Jelgava prosecutors Zinaida Egli, appeared last week. The KNAB did not comment much on the proposed criminal proceedings, but only stated that it was proposed organization of bribery, bribery, incitement to disclose undisclosed information and disclosure of undisclosed information.

According to unofficial information at the disposal of the LTV News Service, former Attorney General Kalnmeier is suspected of unauthorized disclosure of information.

Called, he said, “I didn’t comment on anything. (..) Thanks for the call and all the best.”

As unofficially known to the LTV News Service, shortly before the end of his term of office, Kalnmeiers disclosed information about the procedural activities related to the Egle case to several prosecutors, one of whom, Chief Prosecutor Elita Jurkjāne, passed it on to his wife, lawyer Juris Jurkjāns. Through him, the information has reached the lawyer Ieva Cīrule, who together with Egli figures in the bribery episode of this process.

Cīruli and Jurkjāns are also connected with Egli by friends on the social network “Facebook”. Neither Cīrule nor her lawyer wanted to comment on the situation.

“I can’t provide any information at the moment,” LTV told Cirule. Lawyer Saulvedis Vārpiņš said: “Considering that I have signed documents on non – disclosure in criminal proceedings, unfortunately I cannot answer you. It was a pleasure to hear, all the best. ”

Almost identical answers to the question about the procedural status of the case are also provided by Jurkjāni. “Unable to confirm. I will not approve anything and I will not provide any comments, “Jurkjāns said on LTV. Jurkjāne also refused to comment:” There are no comments on this issue. “

The new Prosecutor General Juris Stukāns confirmed LTV –

KNAB has applied a security measure to Jurkjāne, which prevents her from holding her current position, and by Stukāns’ decision she has been suspended from it for the time of watching the proceedings.

In turn, as LTV revealed in the KNAB, an episode about the leak of information from the criminal proceedings on bribery was distributed and sent to the prosecutor’s office on Tuesday, August 4, which has to decide on taking the case to court.

“KNAB has sent the case materials to the Prosecutor General’s Office, urging to initiate criminal prosecution against one former and one current official of the Prosecutor General’s Office, as well as one natural person. A criminal case has been initiated against officials “The specific criminal case has been separated from the criminal proceedings already initiated by the KNAB,” said Pauls Vilsone, a representative of the KNAB.

At the end of the day, the prosecutor’s office received a criminal case from the KNAB, which means that in the next ten days it will have to decide whether to take it to court.

As Stukāns admitted in a conversation with LTV, he has no reason to doubt the suspicion expressed by the KNAB that Chief Prosecutor Jurkjāne and former Prosecutor General Kalnmeiers have disclosed undisclosed information.

“If this case has been prosecuted, the supervising prosecutor has been notified of the initiation of the proceedings … If he considers that this is not the case, he should annul these decisions in accordance with the law. If the supervising prosecutor does not act and the precautionary measures are followed, I have no “There is reason to believe that this would not be what is indicated in the decisions. So the reason for KNAB to start the process was,” said Stukāns.

“(..) If the prosecutor has broken the law, he will receive the penalty prescribed by law, there is no option,” said the new attorney general.

The criminal law on the disclosure of undisclosed information, which is not a state secret, provides for imprisonment for a term of up to one year or with temporary imprisonment, or with forced labor, or with a fine.

The prosecutor’s office will now have to decide whether to prosecute. The law allows the prosecutor’s office to agree with the accused on the sentence, to make a decision on the termination of the criminal case, or to return the case to the KNAB with instructions on the need for additional investigation.

On July 11, the term of office of the Prosecutor General of Kalnmeier expired, and he was replaced the new Attorney General Stukāns.

Kalnmeier has been the Prosecutor General since 2010. Prior to that, he held the position of Chief Prosecutor of the Criminal Division of the Criminal Justice Department of the General Prosecutor’s Office.
