Karakachanov scandalized by asking the Constitutional Court what “gender” is in order to have a solution for transgender people

The Deputy Prime Minister and Minister of War Krassimir Karakachanov came up with a position on the series of issues related to equality before the law and the prohibition of gender discrimination submitted by the Civil Chamber of the Supreme Court of Cassation (SCC) to the Constitutional Court, the press center of his party – VMRO.

What is the explanation of the term “sex”, adopted by the Constitution, and does it have an independent psychological or social expression, different from the biological one? Does the right to privacy, as defined by the EU Charter of Fundamental Rights and the European Convention on Human Rights, take precedence over this explanation? These are some of the questions that the Civil Collegium of the Supreme Court of Cassation addressed to the Constitutional Court two days ago on the occasion of the interpretative case, in which it must answer the question whether legal gender reassignment is permissible in transsexualism..

The request of the Supreme Court of Cassation states that if it decides that legal gender reassignment is permissible in Bulgaria, it will have to to clarify under what preconditions this can happen. The opinions set out in the interpretative case set out the following requirements: transsexuality of the applicant, legal capacity and not to be married (in view of the fact that when changing gender, it turns out that he is of the same sex with his husband, and this is inadmissible under the Constitution).

On this occasion, Karakachanov said: “For me as Deputy Prime Minister interference in topics such as the family, Christianity, children, their protection by the state directly affects national security. The Supreme Judges ask the Constitutional Court to answer whether the term “sex”, which is defined at the level of the Basic Law, is within these set limits or could be interpreted as “an independent psychological and / or social expression, different from the biological one?”.
