Judge dismisses Sywert van Lienden at his own mouth cap foundation

The Public Prosecution Service asked for his resignation. Justice thinks that Van Lienden has channeled customers from the mouth masks foundation – he himself claims to have started it without a profit motive – to a commercial company. This company was separate from the foundation. This made him millions.

The case was brought by seven ex-employees of the Auxiliary Forces Alliance foundation and the Public Prosecution Service. The verdict is a defeat for Van Lienden, who insists he has done nothing wrong.

Driving ban

In addition, like his companion Bernd Damme, he may not become a director or supervisory director of a foundation for the next five years, the court reports.

According to the court, the directors, especially Van Lienden, emphasized to the outside world that they are ‘disinterestedly committed to care with SHA’. But the distinction between SHA and the commercial BV was not clear, according to the judges.

One of the deals for the supply of face masks that was closed was with the Ministry of Health. Van Lienden said in an earlier session that it was precisely the government that wanted to arrange it through commercial delivery. He denied that the creation of SHA was self-serving from the start.

Controversial

The former driver also repeatedly reported in court that he was privately severely affected by the controversy that has arisen. This social controversy has arisen at the hands of Van Lienden and Damme themselves, the court now says.

“Only after the media paid attention to the involvement of the commercial company in the face mask deal and to the double role that the directors had played in it, did they provide more clarity. .”

Van Lienden and Damme were already suspended in April at the request of the Public Prosecution Service. A third business partner, Camille van Gestel, resigned earlier of his own accord. Now that the duo has been fired, a new board is investigating the liability of the former board. In addition to these civil proceedings, a criminal investigation is also underway.

Response: ‘Disappointing’

The court’s decision is disappointing, reports his lawyer Han Jahae. An appeal is being ‘seriously considered’. According to Jahae, 80 percent of the defense’s defense has been ‘disregarded’ by the court.

According to Jahae, there was also no waiting for the report of research agency Deloitte, which is investigating the controversial mouth mask deal. “I am convinced that the outcome would have been different,” says the lawyer.
