A counter-expertise requested in a Saint-Etienne laboratory

After a breathalyser which had proved positive on the day of the tragedy, and blood tests at the Renaison Clinic laboratory confirming a rate of less than 0.1 grams of alcohol per liter of blood, there was “legally, no alcohol”, explained the prosecutor of the Republic of Roanne, Abdelkrim Grini.

Surprised by this almost negative rate, he had preferred to request a counter-expertise in a specialized laboratory in Saint-Etienne in order to confirm these initial analyzes. “With the investigators, we had doubts about the results, especially since the driver had indicated that she had drunk a few beers a few hours before the accident”, confides Abdelkrim Grini, this Friday, April 28.

“We were misled about the criminal action to be taken. If I had known of this alcohol consumption from the start, I would have requested his placement in pre-trial detention.”

The final results reached him, and they turned out to be very different from the first analysis carried out by the Bouvier* laboratory, hosted by the Renaison Clinic in Roanne. La Villerestoise actually had 1.1 grams of alcohol per liter of blood. A rate confirmed by four successive analyses. The biker, who arrived in front, had not survived his injuries. “There is therefore no longer one, but two aggravating circumstances. Which means that she incurs, despite her clean criminal record, plus seven but ten years of imprisonment”, begins the public prosecutor who does not hide his “annoyance” against the Roanne laboratory. “The analyzes were completely erroneous. We were misled about the criminal action to be taken. If I had known of this alcohol consumption from the start, I would have requested his placement in pre-trial detention. I sincerely regret this situation also for the families of the two victims, who have joined as civil parties. The public prosecutor of Roanne calls on the laboratories to be extremely vigilant.

In addition, the autopsies of the 24-year-old biker and the passenger of the 76-year-old cart confirmed their deaths from numerous traumas due to “an extremely violent shock”.

The investigation of the case by the examining magistrate is following its course. Before a trial in the Roanne court, which should be held in the coming months, it will also be necessary to determine the speed at which the 24-year-old motorcyclist was riding.

“A dysfunction yes, but from whom?”
The Bouvier laboratory reacted through the voice of CEO, Jean-Yves Bouvier. “There was a malfunction, that’s clear. But the sampling and identification are done by the Renaison Clinic, the packaging and transfer to Roanne hospital by our services, and the analytical part by the Center hospital in Roanne. When and where did the malfunction take place? I don’t know. We learned of the existence of the malfunction several weeks later. It was then too late to really know what had happened, “a- he asserted.
The Roanne laboratory performs between 50 and 100 services of this type per year, it is the first time, according to Jean-Yves Bouvier, that a malfunction of this order has occurred.
