How to obtain a home insurance certificate? (Update 2021)

The home insurance certificate is essential for tenants, but also for some owners. This document, which justifies that a contract has been signed, is mandatory in certain cases. Let’s see how to get it and to whom it should be given.

The home insurance certificate: what is it?

The home insurance certificate is quite simply a document proving that you have taken out a contract to cover your home., it doesn’t matter if you own it or not.

The comprehensive home insurance certificate is provided by the insurer, as soon as the contract is signed (or within a few days that follow). The formula subscribed to by the insured has no effect: the document is provided in all cases.

The certificate is valid for one year.

This document therefore proves that you are covered at time T by a home contract, and also specifies the insurance period.

The main information that we find on the document are as follows:

  • The identity of the insured and his contact details,
  • The coverage period (specifying the start date of the guarantees),
  • The identification of the insurer (Macif, Axa, Maif, etc.) and his contact details,
  • The main guarantees taken out (even if the certificate does not go into detail on this plan),
  • Identification of the property: address, characteristics, etc.

In which case is the home insurance certificate useful?

The home insurance certificate for the tenant

All tenants must take out home insurance. This applies to an empty, furnished rental, a studio, a villa… This rule is laid down by law, which requires having at least one “rental risk” guarantee (fire, explosion, water damage).

Insofar as it is compulsory, the lessee of the accommodation must prove to the owner that he has taken out home insurance (even if the lease agreement does not say anything about it). This is where the attestation comes in.

The law of July 6, 1989 states that “the tenant is obliged to insure himself against the risks for which he must respond in his capacity as tenant and to justify them when handing over the keys then, each year, at the request of the lessor. . The justification for this insurance results from the delivery to the lessor of a certificate from the insurer or its representative ”.

The home insurance certificate must be submitted :

  • At the signing of the lease (in principle, even before the conclusion of the lease contract),
  • Every year, on the anniversary date of the signature,
  • When the owner requests it.

The certificate must be distinguished here from the home insurance receipt.. The latter proves that you have paid the premium, but is not sufficient to prove your coverage.

More rarely, you may be asked for a certificate in the event of a seasonal rental (when a holiday guarantee is required).

Home insurance certificate for condominium owners

This proof is also useful for owners whose property is in co-ownership. If applicable, they must take out Civil Liability coverage for any damage their apartment may cause. A home insurance certificate must therefore be given to the trustee.

Home insurance certificate as proof of address

Beyond the cases seen previously, know that the certificate is one of the documents “accepted” by the various organizations as proof of address.

However, it must be less than 3 or 6 months. If yours is old, request a new one from the insurer or download it to your personal space.

Home insurance certificate for teleworking

When an employee teleworks, he is covered by the employer’s professional insurance.

If he teleworks full-time, he must inform his insurer, which will provide him with a certificate, to be sent to the employer.

How to obtain your home insurance certificate online?

As a reminder, the document proves the coverage and mentions the main damage guarantees. It is not intended to be specific about the coverage itself. For this, there are the special conditions.

The certificate can be delivered either :

  • In dematerialized version immediately after enrollment: by email, download from the insured’s personal space, etc.
  • By mail.

If for some reason you have not received your certificate, start the insurer without delay, especially if you are a tenant, because the owner will ask you to sign the lease.

It is also possible, with most insurers, to download it at any time on your smartphone or via a computer. (via the personal space). Axa and many others offer a certificate in PDF form that can easily be attached to an email, to the owner for example.

What is the deadline for receiving my MRH insurance certificate?

In terms of the transmission time of the MRH certificate, it all depends on the insurer.

Most of the time, it is immediately available online, as soon as the membership is validated.. It is sent by email or can be downloaded freely from the customer area.

This is the most practical, especially if you sign a lease very soon.

More rarely, it is sent by post, in paper format. Allow a few days for the document to be prepared and add the postal delays. Relaunch the insurer if the certificate is slow to arrive.

It should also be noted that in principle, the insurer will send you the certificate every year, when the contract is renewed. It also remains available at any time on your personal space.

What happens if you do not provide your home insurance certificate?

As we have said, the home insurance certificate is compulsory for the tenant, whether it is at the signing of the lease or after, on each anniversary date.

If the lessee does not provide this document, the owner is entitled to believe that he has not covered himself., and that he therefore did not comply with his legal obligation.

Two major consequences can follow :

  • The owner can put his tenant in default to take out at least one guarantee for rental risks. If, within one month, this has still not been done, he is entitled to terminate the lease contract. The termination of the latter will result in the eviction of the tenant (it will be necessary to call a bailiff).
  • Since the Alur law, the owner can take out home insurance to protect his home and pass its cost on to the rent.

It is always better to choose your own home contract, and therefore your level of coverage. If you are a tenant, consider covering yourself on your side. If the owner does it, you will not choose the guarantees and you will be charged the premium.
