A civil court in Abu Homs ordered a compensation of one million pounds for his wife and daughter in lawsuit No. 290, a total civilian in 2019, which she filed against her husband who is sick with AIDS, to conceal the fact that he fell ill before her marrying her and caused her injury.

The incident started in one of the villages of Kafr El Dawwar Center when the wife’s doctor who followed her pregnancy asked for some tests, and the surprise came when the doctor went out to ask her if any of her family members had AIDS, so she did not believe and went to another laboratory to perform the tests again, and the shock was the positive result. .

The victim added: “I noticed some strange behavior on my husband and his travel repeatedly without telling me, and on one occasion he was very tired and asked him to take him for medical examinations, but he refused and told me that he would be examined at his workplace in Alexandria.”

She continued: “After watching him, I discovered that he was hospitalized in Alexandria, and after he left, I began to investigate the nature of his illness, and I discovered that he was AIDS patient, and that he was taking doses of treatment before marriage.

The victim’s lawyer presented to the court a statement from the Central Administration for Preventive Affairs of the Alexandria Directorate of Health indicating that the defendant was carrying HIV / AIDS and dispensed his medications about 3 months prior to his marriage.

The court stated in the merits of its ruling that the defendant’s marriage to the prosecutor despite the general knowledge of the members of society, which is derived from awareness campaigns published by the state, through the media, about the seriousness of this disease and the reasons for its transmission, including sexual intercourse between the spouses, and its approval in his marriage document From the claimant that he is free from diseases that allow discrimination, is in itself a deviation from normal and customary behavior, which provides the elements of tort liability, error, harm and causal relationship, before the defendant.

The court added: “The plaintiff was subjected to material damage, which constituted a prejudice to her right to life and the integrity of her body, as well as the ongoing treatment expenses required by this disease, to reduce its effects, which requires compensation of 800 thousand pounds.”

The court said: “Also, the disease afflicted the plaintiff in her affection and feelings, and distressed and saddened her heart, and he inherited anxiety and sorrow, and she deserved a compensation that does not eliminate her loss, the court’s ability of 200 thousand pounds.”
