The Military Chamber of the Supreme Court has sentenced five sergeants to one year in prison for harassing and harassing a colleague in Tenerife. The High Military Court has come to correct a sentence handed down by the Fifth Territorial Court of Santa Cruz de Tenerife in which the five accused of seriously harassing a fellow soldier were acquitted. It was the Prosecutor’s Office that appealed to the aforementioned superior and now the soldier has been agreed with the view that the accused are guilty of exercising degrading and humiliating treatment due to their sexual condition. In the sentence, advanced by the newspaper El Día, it is considered proven that the five sergeants, belonging to the Mistral Battery of the Tenerife Field Artillery Regiment, carried out a conduct of workplace and professional harassment by insulting the soldier such as “chihuahua “,” rat “” frustrated man in woman’s body “. For this reason, the court condemns the five defendants to one year in prison, suspension of employment and payment of compensation of 15,000 euros.

Despite this conviction, the Court has rejected the claim of the private prosecution, which was the conviction for a hate crime, since the insults were carried out due to the sexual condition of the victim. In the same way, the sentence states that the unit commanders were aware of the harassment situation and no disciplinary measures were taken.
