The Fifth Specialized Prosecutor of Valledupar ordered to revoke the arrest warrant against the first manager Cielo Gnecco, after a request from the defense.
It should be remembered that the Tax Thursdayin the first instance, refrained from ordering the capture of the first manager, a measure that was revoked on October 6 by the Third Delegate Prosecutor’s Office before the Superior Courtwho ordered his capture.
In that sense, due to competition, the process returned to Fifth Specialized Prosecutor’s Officewhich according to what was published in the first TIMEwould have decided to revoke the security measure in response to a request from the defense.
The lawyers of the first manager turned to two figures. First of all, the article 318 of Law 906 of 2004which stipulates that any of the parties may request the revocation or replacement of the security measure, “presenting the factual elements from which it is possible to infer that the requirements to decree it have disappeared“.
And second, article 363 of Law 600 of 2000, which speaks of the revocation of the assurance measure. “During the investigation, ex officio or at the request of the procedural subjects, the judicial official will revoke the security measure when evidence arises that refutes it.“says the article. The defense would have presented arguments to distort the evidence against the first manager.

W Radio revealed that the Attorney General’s Office will ask the Judicial Disciplinary Commission to investigate the fifth specialized prosecutor Nancy del Carmen Martínez“for having revoked the arrest warrant against Cielo Gnecco“.
Last Friday, October 6, the Third Delegate Prosecutor before the Superior Court issued an arrest warrant against Cielo Gnecco Cerchiaro for the crimes of extortionate kidnapping and homicide of a protected person.
