Federal Court Invalidates University’s Disciplinary Code Allowing Fines and Community Service

With a new disciplinary code, erring students should be punished with fines of up to 4,000 francs, for example if they employ a ghostwriter or take part in political disruptive actions. Community service would have been possible as an alternative to a fine.

The Federal Court declared this new disciplinary code invalid in October. Such punishments would have to be anchored in university law; this would not be possible through a regulation.

The University Council has taken note of the Federal Court’s decision. The university is now refraining from introducing a cash payment as a disciplinary measure, as the cantonal higher education office announced at the request of the Keystone-SDA news agency. (sda)
